When we collect information

We collect information about you if you:

The types of personal information we collect

Depending on the purpose for which we use your data, we may collect, store and use certain personal information that is disclosed to us by you including your name, status, date of birth, address, telephone, mobile and fax number, email address and details of your vehicle and the purchases made including fitting appointment details and payment details. As and where required, such information may also include photographic identification and proof of address.

We collect information about your vehicle from the Driver and Vehicle Licensing Agency (DVLA) and the Driver and Vehicle Standards Agency (DVSA), in particular to confirm details of the vehicle’s registration and MOT status.

We may also receive information about you from third parties (such as credit reference agencies) who are legally entitled to disclose that information. We may also collect details of your computer's or device's internet protocol address which will be automatically collected by our web server. With the use of cookies we may collect information relating to when and how you visit and use our Websites and services.

We operate Closed Circuit television (CCTV) systems at some of our sites including around the perimeter of the same. This includes CCTV recording of external site areas covering walkways, roads and other public areas. To run the processes set out above, we may process images of you. This may also capture vehicle registration information.

Telephone calls to ATS Euromaster may be recorded as part of our customer service policy and for training purposes.

SHARING PERSONAL INFORMATION WITHIN ATS EUROMASTER, WITH OUR SERVICE PROVIDERS, OUR REGULATORS

We share your information in the manner and for the purposes described below:

i.    ATS Euromaster is part of the Euromaster group of companies. Your information may be shared with other companies in Euromaster group, including Euromaster Services et Management and Euromaster Tyre & Services Romania SA, where such disclosure is necessary to provide you with our services or to manage our business;

ii.    with third parties who help manage our business and deliver services. These third parties have agreed to confidentiality restrictions and use any personal information we share with them or which they collect on our behalf solely for the purpose of providing the contracted service to us. These include IT service providers who help manage our IT and back office systems;

iii.    with the third party consumer review website, Trustpilot, who host and manage customer reviews, including reviews solicited direct from customers. An agreement is in place with Trustpilot restricting the use of any personal information we share with them solely for the purpose of the review website.

iv.    with the third party consumer review host, Driver Review, which hosts and manages the reviews requested direct from customers. An agreement is in place with Driver Review to maintain the confidentiality and security of personal data and to strictly limit the use of your personal data in accordance with the instructions we have given them.

v.    with credit reference agencies and organizations working to prevent fraud; 

vi.    with our regulators and law enforcement organizations, to comply with all applicable laws, regulations and rules, and requests of law enforcement, regulatory and other governmental agencies.

vii.    we may share in aggregate, statistical form, non-personal information regarding the visitors to our website, traffic patterns, and website usage with our partners, affiliates or advertisers.

viii.    If, in the future, we sell or transfer some or all of our business or assets to a third party, we may disclose information to a potential or actual third party purchaser of our business or assets.

ix.    If you chose to pay using Klarna we will pass your contact details and details of your purchase to Klarna at the checkout to enable Klarna to assess whether they can extend payment terms to you. Any personal data we pass to Klarna will be processed in accordance with Klarna’s own Privacy Notice.

TRANSFERRING PERSONAL INFORMATION GLOBALLY

ATS Euromaster is part of the Euromaster group of companies which operates on a global basis. Accordingly, your personal information may be transferred and stored in countries outside the EU that are subject to different standards of data protection. We will take appropriate steps ensure that transfers of personal information are in accordance with applicable law and carefully managed to protect your privacy rights and interests and transfers are limited to countries which are recognized as providing an adequate level of legal protection or where we can be satisfied that alternative arrangement are in place to protect your privacy rights. To this end:

  • where we transfer your personal information outside ATS Euromaster to third parties who help provide our products and services, we obtain contractual commitments from them to protect your personal information. Some of these assurances are well recognized certification schemes like the EU - US Privacy Shield for the protection of personal information transferred from within the EU to the United States; or
  • where we receive requests for information from law enforcement or regulators, we carefully validate these requests before any personal information are disclosed.

You have a right to contact us for more information about the safeguards we have put in place (including a copy of relevant contractual commitments) to ensure the adequate protection of your personal information when this is transferred as mentioned above.

 

HOW WE PROTECT AND STORE YOUR INFORMATION

Security

We have implemented and maintain appropriate technical and organisational security measures, policies and procedures designed to reduce the risk of accidental destruction or loss, or the unauthorised disclosure or access to such information appropriate to the nature of the information concerned. Measures we take include placing confidentiality requirements on our staff members and Service Providers; destroying or permanently anonymising personal information if it is no longer needed for the purposes for which it was collected.

We understand that the security of your payment details is very important to you, and indeed it is to us. There are various ways in which we provide security for your details when you make payments over the internet:-

  • All credit and debit card payments are processed through our Payment Service Provider OGONE. OGONE are accredited with the PCI Security Standards Council and their systems and processes comply with the PCI Data Security Standard. All transactions containing card information are transmitted over the internet in an encrypted form using the Secure Socket Layer (SSL) protocol, currently with a minimum effective symmetric key length of 128 bits.   • In addition, card payments are authenticated by OGONE using the banking institutions' authentication processes Verified by Visa and Mastercard Secure code (collectively referred to as 3D Secure).

Storing your personal information

We will store your personal information for as long as is reasonably necessary for the purposes for which it was collected, as explained in this notice. In some circumstances we may store your personal information for longer periods of time, for instance where we are required to do so in accordance with legal, regulatory, tax, accounting requirements.

In specific circumstances we may store your personal information for longer periods of time so that we have an accurate record of your dealings with us in the event of any complaints or challenges, or if we reasonably believe there is a prospect of litigation relating to your personal information or dealings.

You have a right to request that we rectify inaccurate personal information. We may seek to verify the accuracy of the personal information before rectifying it.

You can also request that we erase your personal information in limited circumstances where:

  • it is no longer needed for the purposes for which it was collected; or

  • following a successful right to object (see right to object); or
  • it has been processed unlawfully; or
  • to comply with a legal obligation to which we are subject.

We are not required to comply with your request to erase personal information if the processing of your personal information is necessary:

  • for compliance with a legal obligation; or
  • for the establishment, exercise or defence of legal claims;

Right to restrict the processing of your personal information

You can ask us to restrict your personal information, but only where:

  • its accuracy is contested, to allow us to verify its accuracy; or
  • the processing is unlawful, but you do not want it erased; or
  • it is no longer needed for the purposes for which it was collected, but we still need it to establish, exercise or defend legal claims; or
  • you have exercised the right to object, and verification of overriding grounds is pending.

We can continue to use your personal information following a request for restriction, where:

  • we have your consent; or
  • to establish, exercise or defend legal claims; or
